Terms of Service

Welcome. These Terms of Service ("Terms") are the agreement between you and PeptaVive Men when you use peptavivemen.com or any of our tools, features, and content. I've kept these in plain English so they're easy to read. By using PeptaVive Men, you're agreeing to them.

1. Who these terms are between

These Terms are between you ("you," "the user") and PeptaVive, operated by Patricia Sharkey ("PeptaVive," "PeptaVive Men," "we," "us," "our"). When PeptaVive LLC's registration is complete with the state of Georgia, the LLC will be the operating entity under these Terms.

2. What PeptaVive Men is — and what it isn't

PeptaVive Men is an educational platform that provides AI-powered information, calculators, and guidance about peptides, hormones, TRT, PCT, sleep, longevity, and supplements, with a focus on the needs of men navigating midlife hormonal and metabolic shifts.

PeptaVive Men is not a healthcare provider. We are not doctors, pharmacists, dietitians, or licensed medical professionals. Nothing on this site — including any tool output, article, calculator result, advisor response, or piece of content — is medical advice, diagnosis, prescription, or treatment.

You should always consult a qualified healthcare provider before starting, stopping, or changing any supplement, peptide, medication, or wellness practice. See our Medical Disclaimer for more.

3. Who can use PeptaVive Men

You must be at least 18 years old to use PeptaVive Men. By using the site, you confirm that you are 18 or older.

PeptaVive Men is operated from the United States. If you access it from elsewhere, you're responsible for complying with the laws of your country.

4. Accounts and membership

Some features of PeptaVive Men — including saving information across devices, using Ask PeptaVive's memory features, and certain Member-only tools — require an account. When you create one, you agree to:

• Provide accurate information
• Keep your login details private
• Notify us immediately if you suspect someone else has accessed your account
• Use the account only for yourself, not on behalf of others

You're responsible for everything that happens under your account. We can suspend or close any account that violates these Terms, abuses our tools, or harms other users.

5. Member subscriptions

Members pay a monthly subscription, processed through Stripe. Current pricing is $12.99/month. Rates may change over time — but whatever rate you sign up at is the rate you keep for as long as your membership remains continuously active. If you cancel and later rejoin, current pricing applies. This is our Lifetime Rate Guarantee.

By becoming a Member, you agree to:

• Recurring monthly billing at the rate shown when you signed up
• A right to cancel at any time, with cancellation effective at the end of your current billing cycle
• No refunds for partial months, though access continues through the end of any month you've already been billed for

To cancel, email getpeptavive@gmail.com and we'll handle it personally. As we grow, we may add self-serve cancellation in your account settings; when we do, these Terms will be updated.

6. Free trials

We offer a 7-day free trial that gives you unlimited access to our tools. To start the trial, you provide your email address — no credit card required. When the trial ends, you lose access to the trial features unless you choose to become a Member. We do not auto-charge you at the end of the trial.

7. Acceptable use

You agree not to:

• Use PeptaVive Men for any unlawful purpose
• Try to break, hack, scrape, reverse-engineer, or interfere with the site or its tools
• Use PeptaVive Men to harm others, including by sharing our content as if it were medical advice to other people
• Resell, redistribute, or commercially exploit our tools, content, or AI outputs without written permission
• Submit false, misleading, or harmful information into our tools
• Use automated systems (bots, scrapers, crawlers) to access PeptaVive Men without permission

If you do any of these, we can suspend or terminate your access without notice.

8. Our content and intellectual property

All content on PeptaVive Men — including our articles, tool designs, branding, logos, illustrations, and AI-generated outputs in response to your inputs — is owned by PeptaVive or licensed to us. You may read it, share links to it, and use tool outputs for your own personal wellness. You may not copy, republish, or commercialize our content without written permission.

9. Your content

When you enter information into our tools (vials, supplements, medications, symptoms, lab values, etc.), you keep ownership of that information. You give us permission to use it to deliver the tool's results to you, and — only if we have your consent — to improve our tools.

10. AI outputs — important

Many of our tools use artificial intelligence to generate suggestions, calculations, or written guidance. This includes Ask PeptaVive, our AI advisor. AI is powerful but imperfect. Outputs may occasionally be inaccurate, incomplete, or out of date. You agree to:

• Use AI-generated outputs as a starting point, not a final answer
• Verify anything important with a qualified healthcare provider
• Not rely on PeptaVive Men as the sole basis for decisions about your health

11. Third-party services

PeptaVive Men uses trusted third-party providers, including Mailchimp (email), Stripe (payments), Netlify (hosting), Supabase (Member data storage), and Anthropic (AI processing for Ask PeptaVive). When you interact with those services through PeptaVive Men, their terms and privacy policies also apply.

We may link to third-party websites or products. We are not responsible for the content, accuracy, or practices of any external site.

12. Disclaimer of warranties

PeptaVive Men is provided "as is" and "as available." We do not guarantee that:

• The site will be uninterrupted, error-free, or always available
• Any specific tool, feature, or result will meet your expectations
• AI outputs are always accurate or appropriate for your situation
• Use of PeptaVive Men will produce any specific health, wellness, or other outcome

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the fullest extent permitted by law, PeptaVive, its founder, employees, contractors, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, lost data, personal injury, or health outcomes — arising out of or related to your use of the site.

Our total liability to you for any claim related to PeptaVive Men is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred US dollars ($100).

Some jurisdictions don't allow certain limitations of liability. If you live in one, parts of this section may not apply to you.

14. Indemnification

You agree to defend and hold harmless PeptaVive, its founder, and its affiliates from any claims, damages, or expenses (including reasonable attorney's fees) arising from your misuse of the site, your violation of these Terms, or your violation of any rights of another person.

15. Dispute resolution and arbitration

Before any formal dispute, please email getpeptavive@gmail.com so we can try to resolve it directly. Most issues can be handled this way.

If we can't resolve it informally, you and PeptaVive agree that any dispute will be settled by binding arbitration under the rules of the American Arbitration Association, conducted in or near Cherokee County, Georgia, or by phone or video at the arbitrator's discretion. You and PeptaVive both waive the right to bring claims as part of a class action, class arbitration, or representative proceeding.

This arbitration agreement does not prevent either party from seeking injunctive relief in court for intellectual property violations or unauthorized access to the site.

16. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any matters not subject to arbitration will be brought in the state or federal courts located in Cherokee County, Georgia.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date at the top and, where appropriate, notify you by email. Continued use of PeptaVive Men after changes means you accept the updated Terms.

18. Termination

You can stop using PeptaVive Men at any time. We can suspend or close your access if you violate these Terms or misuse the platform. Sections that by their nature should survive termination — including disclaimers, limitation of liability, indemnification, and dispute resolution — will continue to apply.

19. Severability and entire agreement

If any part of these Terms is found to be unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy and Medical Disclaimer, are the entire agreement between you and PeptaVive Men about your use of the site.
